General Terms and Conditions Buzmotive
Effective date: 1 December 2024
1. General
1.1 These General Terms and Conditions apply to all offers, orders, deliveries, agreements and other services of Buzmotive.
1.2 Buzmotive supplies exclusively to business customers within the European Union (EU). Private individuals cannot use our services. This means that as a buyer you cannot invoke the right of withdrawal or other consumer rights that apply to private purchases. Please be aware of this when placing your order. Do you have questions? 1.3 By placing an order, the customer declares to agree with these General Terms and Conditions.
2. Offer and Agreement
2.1 All offers on the Buzmotive website are without obligation.
2.2 An agreement is concluded at the moment Buzmotive confirms an order in writing or electronically.
2.3 Buzmotive reserves the right to refuse orders without giving reasons.
3. Prices and Payments
3.1 All prices on Buzmotive are exclusive of VAT and any shipping costs.
3.2 Payment is usually made via direct online payment, such as iDEAL or credit card, through our secure payment provider.
3.3 In exceptional cases, delivery on account can take place. In that case, a payment term of 30 days after the invoice date applies, unless otherwise agreed in writing.
3.4 If payment is not made on time, the customer is in default by operation of law. In that case, Buzmotive has the right to charge statutory commercial interest and extrajudicial collection costs.
4. Delivery
4.1 Deliveries take place within the European Union.
4.2 The indicated delivery times are indicative and do not bind Buzmotive.
4.3 The risk of loss or damage to the products passes to the customer at the time of delivery.
5. Retention of Title
5.1 All delivered products remain the property of Buzmotive until full payment has been made.
5.2 The customer is not entitled to pledge or otherwise encumber the delivered products before ownership has been transferred.
6. Returns and Cancellations
6.1 Returns are only accepted if agreed in writing in advance.
6.2 Specially manufactured or custom-made products cannot be returned.
6.3 Cancellations of orders can only be made in consultation and depend on the status of the order.
7. Liability
7.1 Buzmotive is not liable for any indirect damage, including consequential damage, loss of profit or business interruption.
7.2 The liability of Buzmotive is at all times limited to the amount paid by the customer for the relevant products.
8. Force Majeure
8.1 In case of force majeure, Buzmotive has the right to suspend or dissolve the execution of the agreement without this leading to any compensation.
8.2 Force majeure means any circumstance beyond the reasonable control of Buzmotive, such as natural phenomena, strikes, government measures, or technical failures.
9. Applicable Law and Disputes
9.1 Dutch law exclusively applies to all agreements with Buzmotive.
9.2 Disputes arising from or in connection with these General Terms and Conditions will be submitted to the competent court in the Netherlands.
